煙草在線據《煙業通訊》報道編譯　　據法新社報道，印度尼西亞不久前曾提起訴訟，認為美國禁止在國內銷售丁香煙的禁令違反了國際貿易法規的規定，美國就這一訴訟提起上訴，4月4日，世界貿易組織（WTO）駁回了美國的上訴請求。

　　美國2009年6月頒布了《美國家庭吸煙預防和煙草控制法案》，禁止銷售有特殊香味的卷煙產品，此規定旨在降低年輕人不斷上漲的吸煙率，因此，丁香煙便成為了該法案的犧牲品。

　　然而，該禁令沒有將薄荷卷煙包括在內，因此印尼向WTO提起訴訟，起訴美國，認為該法案沒有包括薄荷卷煙，并沒有做到完全覆蓋適用。

　　WTO曾在9月做出裁決，認為該禁令具有歧視性，但并未表示該禁令是多余的。

　　美國就這一裁決提起上訴，上訴委員會決定維持原判，并呼吁美國采取措施遵守其在WTO的責任與義務。

WTO tells US to end kretek discrimination

　　The World Trade Organization yesterday threw out the US' appeal against Indonesia's complaint that a US ban on the domestic sale of kreteks infringed international trade rules, according to an Agence France Presse story.

　　Kreteks fell victim to the US Family Smoking Prevention and Tobacco Control Act, which, in June 2009, banned the sale of cigarettes with characterizing flavors, purportedly to reduce the uptake of smoking by young people.

　　The ban, however, did not include menthol cigarettes and Indonesia lodged a complaint against the US at the WTO, arguing that the act had not been applied uniformly since it did not cover menthol cigarettes.

　　The WTO ruled in September that the ban was discriminatory, though it did not say it was unnecessary.

　　And while the US appealed against the finding, the appeal panel agreed with the original ruling and called on the US to bring its measures into conformity with its WTO obligations.
